 Welcome to Trending Face (“we,” “us,” “our,” or “Trending Face”). These Terms and Conditions (“Terms”) govern your access to and use of the website, mobile application, and related services (collectively, the “Site”) operated by Trending Face, and any purchases of products through the Site. 

By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site. 

1. Eligibility 

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site or make purchases. By using the Site, you represent that you meet this requirement. 

2. Account Registration 

You may need an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use at shop@trendingface.com. 

3. Products, Pricing, and Orders 

• Product descriptions, images, and pricing are subject to change without notice. We strive for accuracy but do not guarantee that product information is complete, current, or error-free. 
  

• All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including pricing errors, suspected fraud, or stock issues. 
  

• Prices are displayed in United States Dollars and do not include applicable taxes, shipping, or handling fees, which will be calculated at checkout. 
  

• Payment is due at the time of order. We accept most major credit cards, AfterPay, and Klarna. You authorize us to charge the payment method provided. 
  

Payment Authorization and Fraud 

By submitting a payment method for any order, you represent and warrant that: 

• You are the authorized cardholder or account holder of the payment method used; 
  

• You are authorized to use that payment method for the purchase; 
  

• All information you provide (including billing name, address, and payment details) is accurate and complete; and 
  

• You will not use a stolen, lost, or otherwise unauthorized payment method. 
  

You are solely responsible for all charges incurred under your account or with any payment method you provide, including any unauthorized or fraudulent use, until you notify us and your card issuer. You agree to notify your card issuer and us immediately of any unauthorized use. 

 We reserve the right to refuse, cancel, or delay any order, or to require additional verification, if we suspect fraud, unauthorized use, or any other risk. We may share information with payment processors, fraud-prevention services, and law enforcement as needed to investigate and prevent fraud. 

 Chargebacks and Disputed Transactions 

If you initiate a chargeback, payment dispute, or claim of unauthorized transaction with your bank or card issuer after receiving the product(s), or if a chargeback is filed for any reason related to an order you placed or that was placed using information associated with you, you agree that: 

• You remain responsible for the full amount of the order (including any shipping, taxes, and fees) if the products were shipped to the address you provided and/or delivered or accepted; 
  

• Filing a chargeback or dispute after accepting delivery of the products, or for reasons other than legitimate non-receipt, defective goods covered by our return policy, or proven unauthorized use that was promptly reported, constitutes a breach of these Terms; 
  

• We may submit evidence (including order records, IP/device data, shipping and delivery confirmation, and communications) to contest the chargeback; and 
  

• You will indemnify and hold Trending Face harmless from any resulting chargeback fees, losses, costs, or expenses (including reasonable attorneys’ fees). 
  

Nothing in these Terms limits your rights under applicable card-network rules or consumer-protection laws, but you agree not to abuse the chargeback process. 

 Indemnification 

You agree to indemnify, defend, and hold harmless Trending Face and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including chargeback fees, payment-processor penalties, and reasonable attorneys’ fees) arising out of or related to: (a) your use of a payment method that is stolen, unauthorized, or otherwise fraudulent; (b) any chargeback, dispute, or claim of unauthorized transaction related to an order associated with you; (c) false or misleading information you provide; or (d) your breach of these Terms. 

 Limitation of Liability 

To the maximum extent permitted by law, Trending Face shall not be liable for any losses arising from unauthorized or fraudulent use of payment methods by third parties, chargebacks initiated by cardholders, or any resulting reversal of funds, except to the extent caused by our gross negligence or willful misconduct. You acknowledge that online payments carry inherent risks of fraud and that you bear responsibility for safeguarding your payment credentials. 

4. Shipping, Delivery, and Risk of Loss 

Shipping times and costs are estimates only. Title and risk of loss pass to you upon delivery to the carrier. We are not responsible for delays caused by carriers, customs, or events beyond our control. 

5. Returns, Refunds, and Exchanges 

All sales are final. We do not accept returns, refunds, or product exchanges for any reason, including change of mind, dissatisfaction with results, or preference. 

Hygiene and safety rules apply to beauty and personal-care products. Opened, used, or unsealed items cannot be returned. 

The only exception is products that arrive damaged or defective. Such cases are reviewed on a case-by-case basis by our customer service team. You must contact us at shop@trendingface.com within 5 days of delivery and provide clear photos of the damaged product(s) and the shipping package(s). If we determine the product was damaged in transit or defective upon arrival, we will, at our sole discretion, offer a replacement or store credit. 

Please contact shop@trendingface.com for assistance with any damaged-item claim. Failure to contact us before initiating a chargeback or payment dispute may affect our ability to assist and may be considered when we respond to any chargeback. 

6. Product Claims, Effectiveness, and Medical Disclaimers 

All claims of product effectiveness may vary by individual. 

Claims on beauty products should not be considered as medical advice and products should not be used to treat medical conditions. Anyone seeking medical advice or products to treat medical conditions should seek a physician. 

We are not responsible for any adverse reactions potentially caused by using products sold on this site. If an individual does experience an adverse reaction from products purchased on this site, please seek immediate medical supervision from a healthcare professional. 

Any claims and liabilities are at the responsibility of the product’s manufacturer and not with Trending Face. 

Products sold on the Site are cosmetic or personal-care items intended for external use as directed. Always follow label instructions, perform patch tests where recommended, and discontinue use if irritation occurs. Consult a qualified healthcare professional before use if you have allergies, skin conditions, are pregnant, nursing, or have any medical concerns. 

7. Intellectual Property 

All content on the Site (text, graphics, logos, images, product descriptions, software, etc.) is owned by Trending Face or its licensors and is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, modify, or create derivative works without our prior written permission.

8. User Content and Conduct 

If you submit reviews, photos, comments, or other content (“User Content”), you grant Trending Face a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, and distribute that content in connection with the Site and our business. You represent that you own or have rights to the content and that it does not violate any third-party rights or applicable law. 

You agree not to: 

• Use the Site for any unlawful purpose 
  

• Upload malicious code, spam, or harmful content 
  

• Infringe intellectual property or privacy rights 
  

• Harass, defame, or harm others 
  

• Attempt to gain unauthorized access to systems or data 
  

We may remove User Content or suspend accounts that violate these Terms.

10. Disclaimer of Warranties 

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. 11. Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRENDING FACE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE RELEVANT ORDER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction there.
